Hereinafter referred to as “BABY NIDO”.

Hereinafter referred to as “the Client” .
These conditions govern the sale of any product presented on the “BÉBÉ NIDO” site by the individual company BÉBÉ NIDO.
The parties agree that their relations will be exclusively governed by this contract, to the exclusion of any other conditions.
The items are only offered for sale to non-commercial individuals.
They are concluded intuitu personae and cannot therefore be the subject of any transfer, of any nature whatsoever.
Any order duly validated on the BÉBÉ NIDO website implies full and unreserved acceptance of these general conditions of sale and, possibly, the particular or specific conditions for one or more products or orders.
1. OBJECT
These conditions aim to define the reciprocal obligations of the parties as well as the different stages of the order process.
2. ITEMS AND PRODUCTS
BÉBÉ NIDO is a site which aims to offer for sale items such as diapers, infant milk, baby hygiene products, distributed by BÉBÉ NIDO.
The items visible on the site are available while stocks last.
Consequently, the individual company BÉBÉ NIDO does not in any way guarantee that the products will remain on sale for a given period.
Any complaint from the customer regarding the order or delivery of an unavailable item will be considered unfounded.
In the event of debit or collection for the order of an unavailable item, the individual company BÉBÉ NIDO undertakes within 5 working days to reimburse the customer for the amount of the order.
The individual company BÉBÉ NIDO endeavors to notify by email any customer who has placed an order for an unavailable item.
The products offered for sale are described and presented with the greatest possible accuracy.
However, if errors or omissions may have occurred in this presentation, the responsibility of the individual company BÉBÉ NIDO cannot be engaged.
Photographs illustrating the products in support of the text do not fall within the contractual scope.
3. PRODUCT PRICES AND DELIVERY
Prices are presented in euros. Delivery is free via Mondial Relay for purchases over €50 for mainland France. For more details see our delivery policy.
The VAT included is the French VAT at the rate in force for the products concerned. If the VAT rate were to be modified, these changes may be reflected in the price of the items without the customer being informed in advance.
The order is shipped within 24/48 working hours (Monday to Friday) from receipt of the order.
The delivery of products is done through transport providers. The delivery time is generally 24 hours to 48 hours for mainland France (excluding sales/black Friday periods).
Products shipped outside the European Union are zero-rated (without VAT), the tax-free amount is automatically deducted from the invoice (Australia, Canada, Korea, Hong Kong, Japan, Singapore, Switzerland, USA, etc.).
Any order placed on the site and whose country (or region) of delivery is outside the European Union may be subject to customs duties. These customs duties are imposed by the regulations in force in the country. These taxes are the responsibility of the customer and are his responsibility. We have no control over these charges, and are unable to determine the amount in advance. Customs duties and clearance policies vary greatly from country to country, we recommend that you contact the relevant local authorities for further information.
If the recipient refuses to pay customs duties or taxes, any sums requested and taxed from bebelolo.fr to collect this package will be deducted from the amount of the reimbursement made to the customer.
4. ORDER
The customer interested in an item visible on the BÉBÉ NIDO website follows the following process to place their order.
After clicking on the “Add to cart” icon and after checking the specifics of their order (color, quantity, price, etc.), the customer validates the choice of the selected product(s) with a click.
He then enters his contact details with the following mandatory information: title, surname, first name, full delivery address, e-mail and telephone number.
Delivery and billing to different addresses are accessible through checkboxes that display new forms.
When the customer clicks on the “Validate” button, he accesses the summary of his order where all the information is recalled.
If the customer benefits from a special offer, he must first enter a code assigned to him in the field provided for this purpose.
Payment terms: the customer can pay by bank card: VISA, MASTER CARD, CART BLEU.
But also via AMERICAN EXPRES; PAYPAL; KLARNA 3X; APPLE PAY; SHOP PAY.
The Customer validates his address, the product and the total price. He provides his bank card number associated with the expiration date.
He finally validates his order by clicking on the “Validate” button.
This validation constitutes a sale and irrevocably binds the parties.
BÉBÉ NIDO will acknowledge receipt of the order upon validation by email or by any other means at its convenience, in accordance with the provisions of article L121-19 of the Consumer Code.
BÉBÉ NIDO reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order and who in its eyes presents any risk.
5. PAYMENT SECURITY
To ensure payment security, the BÉBÉ NIDO site uses the secure payment services of SHOPIFY PAYMENT and MOLLIE. These services integrate the SSL security standard. The confidential data (the 16-digit bank card number as well as the expiration date) is directly transmitted encrypted to the SIPS server without passing through the physical media of the BÉBÉ NIDO server.
When the bank details are validated:
The secure electronic payment manager sends an authorization request to the bank card network.
The electronic payment manager issues an electronic certificate.
6. WARRANTIES AND RETURNS
All items visible on the BÉBÉ NIDO website are eligible for a refund, with the exception of products already used and without their original packaging.
The period during which the customer can request the exchange or assert his right of withdrawal is 30 days from the date of receipt of the item(s). For all requests received by email, a return slip will be sent indicating the address to which the items must be returned. For France the slip can be found in your customer area.
Return costs are free.
Before any return, a return request must be made via your account and this must be validated by our customer service.
Otherwise, no refund will be made.
The return must be made by post, by tracked Colissimo.
To obtain a return slip please follow the following procedure:
Procedure to follow FRANCE and WORLD:
Any return request must be made from your customer area, select the item(s) to return to us. Clearly indicate the reason for your return. After validation of your return by our customer service, you can send the package with the delivery note and the return form present in the package.
In the event of a dispute, BÉBÉ NIDO will require from the customer proof of deposit with the postal service. In the event of loss of package, no refund can be made without this proof of deposit.
Upon receipt of the package by BÉBÉ NIDO, the logistics teams will judge the perfect condition of the returned merchandise. No returns will be accepted if the returned products have been visibly used or damaged by the customer and this use or damage renders the product unfit for sale.
If the return is refused by BÉBÉ NIDO, the products will then be returned to the customer at the expense of BÉBÉ NIDO without the customer being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of its warranty rights on the merchandise sold.
If the return is accepted, we will re-credit your bank account within 10 days.
7. SIGNATURE AND PROOF
For any payment by bank card on the BÉBÉ NIDO website, the electronic certificate issued by the electronic payment manager will constitute proof of the amount and date of the transaction, in accordance with the provisions of articles 1316 et seq. of the Civil Code as well as the means of payment. electronic archiving set up by the individual company BÉBÉ NIDO
In this regard, the date and time of the server will be binding between the parties.
Validation of the order constitutes signature and express acceptance of all operations carried out on the site.
8. IDENTIFICATION
In order to facilitate the identification of the Customer, the Customer expressly authorizes BÉBÉ NIDO to place on the customer's hard drive a so-called "cookie" file whose sole purpose is to facilitate said identification.
The customer who refuses the deposit of such a file on his hard drive must complete the order validation forms in full for each order.
9. RESPONSIBILITY
For all stages of accessing the site, consulting, filling out forms, placing an order, delivering items or any other service, the individual company BÉBÉ NIDO has only an obligation of means.
Consequently, the responsibility of the individual company BÉBÉ NIDO cannot be held liable for any inconveniences or damages inherent in the use of the internet network and totally external to the diligence and precautions taken by BÉBÉ NIDO
In particular, any disruption in the provision of the service, or any external intrusion or presence of computer virus, cannot engage the responsibility of the individual company BÉBÉ NIDO.
Likewise, any event qualified as force majeure within the meaning of the case law of the Court of Cassation completely exonerates the individual company BÉBÉ NIDO from any liability.
10. PERSONAL DATA
The individual company BÉBÉ NIDO, for the purposes of the service, reserves the right to collect personal data relating to users of the site, in particular by means of “cookies” referred to in article 8.
In accordance with law n°78-17 of January 6, 1978, any user or customer of the site may at any time oppose the commercial use of said data and also benefits from a right of access, rectification and deletion of data concerning him.
11. ELECTION OF DOMICILE
The individual company BÉBÉ NIDO declares that it takes up residence at the address indicated at the top of this document.
12. INTELLECTUAL PROPERTY AND COMPETITION
All elements of the BÉBÉ NIDO site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents.
They are the exclusive property of the individual company BÉBÉ NIDO.
The user who has a personal Internet site and who wishes to place, for personal use, on his site a simple link referring directly to the Homepage of the BÉBÉ NIDO site, must first request authorization from the company individual BABY NIDO.
In this case, it cannot be an implicit affiliation agreement.
On the other hand, any hypertext link referring to the BÉBÉ NIDO site and using in particular the technique of framing, deep-linking, in-line linking or any other deep link technique is in any case formally prohibited.
In all cases, any link, even tacitly authorized, must be removed upon simple request from the individual company BÉBÉ NIDO.
13. ENTIRE CONTRACT
These conditions concluded between the individual company BÉBÉ NIDO and the client express the entirety of the obligations of the parties.
No indication, no document can give rise to obligations hereunder if they are not the subject of an amendment signed by both parties.
No correspondence prior to the signing of this contract can give rise to obligations under said contract.
However, if a condition were to be missing, it would be considered to be governed by the practices in force in the sales sector.
14. TOLERANCE OR WAIVER
It is formally agreed between the individual company BÉBÉ NIDO and the customer that any tolerance or waiver by one of the parties in the application of all or part of the commitments provided for in these conditions, whatever the frequency and the duration, cannot constitute a modification of this agreement, nor generate any right.
More specifically, no delay or inaction, abstention or omission on the part of customers in the exercise of any of its rights under this agreement will affect said right, nor will it be considered as implying on its part a waiver of this right.
15. PARTIAL INVALIDITY
If a particular stipulation of these conditions is held to be invalid or declared as such by a decision having the force of res judicata of a competent court, the other stipulations will retain their full force and scope.
16. DISPUTES
The language of these general conditions of sale is French.
Each party may initiate any useful procedure, express jurisdiction being attributed to the courts of the city of Paris.
